Pada 19hb Jun 2011,Presiden Perkasa,Ibrahim Ali dalam satu majlis telah mengeluarkan kata-kata hasutan berunsur keganasan yang ditujukan secara khusus kepada orang-orang berbangsa Cina apabila mengarahkan orang-orang berbangsa Cina jangan keluar dari rumah masing- masing dan perlu menyimpan stok makanan di rumah jika perhimpunan Bersih tidak dibatalkan dan ia diteruskan kerana akan terjadi perkara yang tidak diingini.
Saya percaya bahawa kata-kata ini berunsur hasutan jenayah yang menjurus kepada keganasan secara khusus ditujukan kepada orang-orang berbangsa Cina yang ingin mengamalkan hak untuk berhimpun secara aman sepertimana yang dijamin di bawah Artikel 10 Perlembagaan Persekutuan bebas dari sebarang ancaman keganasan dari mana- mana pihak semasa menyertai perhimpunan Bersih.
Perbuatan Ibrahim Ali ini adalah satu kesalahan jenayah di bawah seksyen 505(c) Kanun Keseksaan dan saya dengan ini menuntut agar Ibrahim Ali ditangkap dan didakwa di Mahkamah sesegera mungkin.
Nota:
1. Artikel 10 Perlembagaan Persekutuan : 10. Freedom of speech, assembly and association.
(1) Subject to Clauses (2), (3) and (4) –
(a) every citizen has the right to freedom of speech and expression;
(b) all citizens have the right to assemble peaceably and without arms;
(c) all citizens have the right to form associations.
(2) Parliament may by law impose –
(a) on the rights conferred by paragraph (a) of Clause (1), such restrictions as it deems necessary or expedient in the interest of the security of the Federation or any part thereof, friendly relations with other countries, public order or morality and restrictions designed to protect the privileges of Parliament or of any Legislative Assembly or to provide against contempt of court, defamation, or incitement to any offence;
(b) on the right conferred by paragraph (b) of Clause (1), such restrictions as it deems necessary or expedient in the interest of the security of the Federation or any part thereof or public order;
(c) on the right conferred by paragraph (c) of Clause (1), such restrictions as it deems necessary or expedient in the interest of the security of the Federation or any part thereof, public order or morality.
(3) Restrictions on the right to form associations conferred by paragraph (c) of Clause (1) may also be imposed by any law relating to labour or education.
(4) In imposing restrictions in the interest of the security of the Federation or any part thereof or public order under Clause (2) (a), Parliament may pass law prohibiting the questioning of any matter, right, status, position, privilege, sovereignty or prerogative established or protected by the provisions of Part III, Article 152, 153 or 181 otherwise than in relation to the implementation thereof as may be specified in such law.
2. Seksyen 505 (c) Kanun Keseksaan : Statements conducing to the public mischief.
Whoever makes, publishes or circulates any statement, rumour or report-
(a) with intent to cause, or which is likely to cause, any officer, soldier, sailor or airman in the Malaysia Armed Forces or any person to whom section 140B refers to mutiny or otherwise disregard or fail in his duty as such; or
(b) with intent to cause, or which is likely to cause, fear or alarm to the public, or to any section of the public whereby any person may be induced to commit an offence against the State or against the public tranquility;
(c) with intent to incite or which is likely to incite any class or community of persons to commit any offence against any other class or community of persons, shall be punished with imprisonment which may extend to two years, or with fine, or with both.
Exception – It does not amount to an offence within the meaning of this section, when the person making, publishing or circulating any such statement, rumour or report has reasonable grounds for believing that such statement, rumour or report is true and makes, publishes or circulates it without any such intent as aforesaid.
